From 1 January 2022, it will be illegal in Spain for telephone operators to make sales calls to customers during “siesta time”. But despite this legal protection against jamming, Vodafone has to pay the man who brought the nuisance call to court €6,000.
The Zaragoza District Court handed down a landmark judgment. The ruling will help protect consumers from similar harassment in the future.
The first judgment in favor of the plaintiffs was handed down in February, but the operator has appealed, according to Spanish daily El País. Vodafone claimed the calls were made by another company impersonating the operator for fraudulent purposes.
The appeals court’s ruling, however, found that Vodafone provided no evidence of this imitation, and that the sole purpose of the 24-hour non-stop calls was an attempt to get men to sign up for their service.
Vodafone has chosen not to appeal to the Supreme Court and must pay the plaintiff €6,000.
According to El Pais, these sales calls are one of the main complaints of Spanish consumers. In response, operators have signed a series of good practice rules, but they are not binding.
Jazztel (orange), Vodafone and MásMóvil are the most persistent operators for sales calls, but Vodafone has been fined the most by the Spanish Data Protection Agency.
Earlier this year. Vodafone was fined his record €8.15 million after failing to change its marketing practices.
