Spain’s Directorate General for Gambling Regulation (DGOJ) has introduced a draft resolution extending its controversial domestic gambling advertising regulation to lottery operators and brokers.
The resolution requires lottery operators, brokers and other entities providing third-party marketing of lotteries to comply with new regulations limiting and specifying marketing and advertising conducted on behalf of the Spanish National Lottery. .
This directive will change the way lotteries are offered online. This includes age verification through national databases on online platforms, notice of inability to participate if underage or otherwise prohibited from playing, and introduction of an official seal of authenticity on the website. but not limited to:
Additionally, brokers are responsible for complying with similar regulations. You must also follow the lottery’s instructions regarding marketing regulations and be transparent about the activities of your sales channels.
Importantly, the resolution extends lotteries and brokers to the provisions of Law 13/2011 of 27 May and subsequent Royal Decree 958/2020 of 3 November.
In short, Law 13/2011 of 27 May 2011, or “Spanish Gambling Law”, requires a license for the operator. On the other hand, Royal Decree 958/2020 of 3 November lays down a number of rules regarding marketing.
In particular, it restricts TV and radio communications between 1:00 am and 5:00 am and prohibits promotional bonuses.
The DGOJ said the purpose of the resolution was to ensure consumer protection and extend the restrictions imposed on gambling advertising to include lotteries.
