Fatal Milwaukee crash, victim’s family questions bail decision

Danali’s mothers, Jackie Peer and Nicole Byrd, believe the person responsible for her son’s death was kept out of prison multiple times because of low bail.
“The fact that my son died is something I still don’t understand. It’s completely unrealistic for me,” Byrd said.
In October, prosecutors said 20-year-old Jai’Quann McMurtry was driving without a valid license when he crashed a stolen Mercedes-Benz into a tree near Appleton and Villard. Police said he was driving at 109 mph just before the crash. Passenger Danali died in the shipwreck.
“He was always there for me. He wants to spend time with me,” Byrd said. “He was… my life.”

McMurtry was released on bail in March 2021 after being charged with “firearm possession by a felony convicted delinquent,” according to court records. In August 2021, McMurtry was released on $3,000 cash bail for his three additional charges of the same crime.
In July of this year, McMurtry was charged with possessing cocaine for the purpose of carrying it. He was released on $500 cash bail after his first court appearance, according to court records.
“The law needs to change. It starts at the top. It’s not just district attorney issues or community issues. It goes way up,” Peer said. “Danali’s justice is that these things need to change.”
Records show McMurtry was posted on bail totaling $76,000. This includes his $50,000 in murder charges resulting from the crash that killed Pia. He has GPS monitoring of him at his home, and his attorney has not commented.
Chisholm’s office told FOX6 News that it does not comment on unresolved cases, and declined an interview.
